Poroy Law Firm

Criminal Law

From investigation to judgment.

In proceedings that directly affect personal liberty, the defence must be built from the very first moment.

Overview

Criminal proceedings directly affect personal liberty, and each stage must therefore be handled with care. The steps taken from the first moment of an investigation form the ground on which the rest of the file is built and can produce consequences that are difficult to correct later.

The firm acts at both the investigation and prosecution stages, for clients appearing as suspects and defendants as well as for victims and intervening parties. The aim is to conduct an effective and diligent defence within the framework of the right to a fair trial and the procedural safeguards.

Points to Note

What matters
in practice.

The points that most affect the outcome in this area, and are most often overlooked.

Right to counsel

When summoned to give a statement as a suspect you are entitled to have defence counsel present. That right is exercised at the most critical moment of the file and forms the basis of the defence.

Time limits for objection

The periods for objecting to custody, detention and judicial control decisions are short. Missing a period may remove the opportunity to have the measure reviewed.

Evidence and procedural safeguards

Evidence obtained through unlawful methods cannot be used in the proceedings. Monitoring the procedural safeguards is an inseparable part of the defence.
