Poroy Law Firm

Sports Law

On the field and off it.

In sport the contest is on the field, but the legal outcome is usually decided in the contract.

Overview

Sport is a field of law with its own rules, arbitration mechanisms and short time limits. The consequences of a transfer, a notice of termination or a disciplinary sanction are usually decided not before the ordinary courts but before the bodies of the federations and the international arbitration tribunals.

In the relationships between athletes, clubs and agents the firm focuses both on forming the contract correctly and on conducting any dispute effectively. The aim is to handle the file before the Dispute Resolution Chamber, the TFF Arbitration Board or the CAS with an approach that commands the particular procedure of this area.

Points to Note

What matters
in practice.

The points that most affect the outcome in this area, and are most often overlooked.

Short application periods

The periods for challenging disciplinary sanctions and board decisions are very short and are often measured in days. Missing the period leaves even a well-founded objection without result.

The finality of arbitration

A significant part of sports disputes is resolved through arbitration rather than the ordinary courts, and those decisions are often final. Framing the process correctly from the outset is therefore critical.

Minor athletes

Contracts with athletes who are minors are subject to special protective rules at both national and international level. Failing to observe them can render the contract invalid.
